Lawsuit Information

You may be affected by a class action lawsuit claiming that Club 360 LLC, Valley Gym Corp, North Hollywood Fitness LLC, Van Nuys Fitness Center LLC, and Jehangir Meher (collectively, “USA Fitness”), and ABC Financial Services, LLC, (along with USA Fitness collectively “Defendants”) automatically withdrew from the checking accounts and/or debit cards of gym members a $9.99 fee during the Covid-19 pandemic closures without obtaining prior written authorization to do so.  The lawsuit, Edwin Bazarganfard and Barak Golan v. Club 360 LLC, et al., Case No. 2:21-cv-02272-CBM-PLA, is pending in the United States District Court for the Central District of California. The Court previously decided that this lawsuit should be a class action on behalf of a group of people who were similarly affected, and records show you are a member of the class.

Am I Affected?

You may be part of this class action if you are a person in the United States whose bank account was debited on a reoccurring basis by USA Fitness, without USA Fitness first having obtained your written authorization to charge you $9.99, between March 14, 2020 and September 30, 2020.

The Court entered judgment in favor of Plaintiff Barak Golan and the Class and against USA Fitness.  The Court entered judgement jointly and severally against Defendants in the amount of $47,672.28 in actual damages, against ABC Financial Services, LLC in the amount of $500,000 in statutory damages, and against USA Fitness in the amount of $184,400 in statutory damages.

What Happens Next?

Once the judgment is fully funded by Defendants, the funds will be disbursed by the Administrator to class members by check.  The Administrator will calculate each Class Member’s share of actual damages based on the transaction data provided by Defendants, and will divide the statutory damages equally among the Class Members on a per-person basis.  If there are any delays to the payment of the judgment, updates will be posted on the case website, which is listed below.
